RESOLUTION TO ADOPT BUDGET
2010 BUDGET


A RESOLUTION SUMMARIZING EXPENDITURES AND REVENUES FOR EACH FUND AND ADOPTING A BUDGET FOR THE EL RANCHO FLORIDA METROPOLITAN DISTRICT,  COLORADO, FOR THE CALENDAR YEAR BEGINNING ON THE LAST DAY OF DECEMBER, 2009.

WHEREAS, the Board of Directors of EL RANCHO FLORIDA METROPOLITAN DISTRICT has appointed Marsha A. Moreland, Budget Officer to prepare and submit a proposed budget to said governing body at the proper time; and

WHEREAS, Marsha A. Moreland, Budget Officer has submitted proposed budget to this governing body on October 7, 2009 for its consideration, and;

WHEREAS, upon due an proper notice, published or posted in accordance with the law, said proposed budget was open for inspection by the public at a designated place.   A public hearing was held on December 3, 2009, and interested taxpayers were given the opportunity to file or register any objections to said proposed budget, and ;

WHEREAS, whatever increase may have been made in the expenditures, like increase were added to revenues so that the budget remains in balance, as required by law.

NOW THEREFORE,  BE IT RESOLVED BY THE Board of Directors of the EL RANCHO FLORIDA METROPOLITAN DISTRICT, Colorado:

SECTION I.  That estimated expenditures for each fund are as follows:

General Fund                               $     55,300.00
Enterprise Fund                                 244,900.00
Conservation Trust Fund                                    4,000.00            

Appropriated Ending Balances              458,625.04

TOTAL ALL EXPENDITURES 2009      $  762,825.04



SECTION II.  That estimated revenues for each fund are as follows:

General Fund                                    $ 180,860.07
Enterprise Fund                                  571,185.78
Conservation Trust Fund                         10,779.19

TOTAL ALL REVENUES 2009              $ 762,825.04

SECTION III.   That the budget as submitted and herein summarized by fund, hereby is approve and adopted as the budget of the EL RANCHO FLORIDA METROPOLITAN DISTRICT for the year stated above.

SECTION IV.  That the budget hereby approved and adopted shall be signed by all 5 members of the Board of Directors of EL RANCHO FLORIDA METROPOLITAN DISTRICT and made a part of the public records of the District.

ISSUES UNDER AMENDMENT NO.1:

While the Colorado Voters on November 3 1992, general election, approved the Amendment No.1, Article X, Section 20 of the Colorado Constitution, the electors of the EL RANCHO FLORIDA METROPOLITAN DISTRICT in May 2004, voted to `De-Bruce’ the District as to revenue and  spending limitations imposed upon them by Article X, Section 20,and for each subsequent year thereafter.

RESOLUTION TO APPROPRIATE SUMS OF MONEY
2010 BUDGET    

A RESOLUTION APPROPRIATING SUMS OF MONEY TO THE VARIOUS FUNDS AND SPENDING AGENCIES, IN THE AMOUNTS AND FOR THE PURPOSE AS SET FORTH BELOW, FOR THE EL RANCHO FLORIDA METROPOLITAN DISTRICT, COLORADO, FOR THE 2009 BUDGET YEAR.

WHEREAS, the Board of Directors has adopted the annual budget in accordance with the Local Government Budget Law, on  December 4, 2008, and;

WHEREAS, the Board of Directors has made provision therein for revenues in an amount equal to or greater than the total proposed expenditures as set forth in said budget, and;

WHEREAS, it is not only required by law, but also necessary to appropriate the revenues provided in the budget to and for the purposes described below, so as not to impair the operations of the District.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF EL RANCHO FLORIDA METROPOLITAN DISTRICT, COLORADO:

SECTION I.  That the following sums are hereby appropriated for the revenue of each fund, to each fund, for the purposes stated:
General Fund
Operating Expenses             $     55,300.00
Ending Balance                          125,560.07
TOTAL GENERAL FUND         $   180,860.07

Enterprise Fund
Operating Expenses               $   93,700.00
Capital Outlay                           151,200.00
Emergency Reserve                     3,940.00

EL RANCHO FLORIDA METROPOLITAN DISTRICT
RESOLUTION TO DESIGNATE A CONSERVATION TRUST FUND
FOR LOTTERY PROCEEDS


WHEREAS, Article 21, of Title 29, C.R.S. 1973, as amended in 1982 by S.B. 119, provides for the Conservation Trust Fund for municipalities, counties and certain special districts, and further provides for net lottery proceeds to be deposited to said fund, and which act authorizes the creation of such fund by El Rancho Florida Metropolitan District; and,

WHEREAS, The Governing Body of El Rancho Florida Metropolitan District has created such a fund for the Health, Safety and Welfare of present and future citizens of this District; and

NOW, THEREFORE BE IT RESOLVED by the Governing Body of El Rancho Florida Metropolitan District, that a Conservation Trust Fund has been created and the same hereby was created pursuant to Article 21 of Title 29, C.R.S 1973, for the El Rancho Florida Metropolitan District, and that monies received from the State of Colorado to this District pursuant to said statutes have been and will continue to be deposited in said fund and expended only for the purposes set forth in said law; and

BE IT FURTHER RESOLVED THAT A COPY OF THIS Resolution be certified to the Colorado Division of Local Government in the Department of Local Affairs.

AFFIDAVIT CERTIFYING THE ESTABLISHMENT OF THE CONSERVATION
TRUST FUND AND THE REQUEST TO DISTRIBUTE THOSE FUNDS


I, John Krispin, the Vice President of the El Rancho Florida Metropolitan District  hereby certify as follows:

1)    That El Rancho Florida Metropolitan District  has established a Conservation Trust            
 Fund pursuant to Article 21, 29-21-101, CRS 1973 as amended.

2)    That  El Rancho Florida Metropolitan District  wishes to qualify for distribution of             
Conservation Trust money under the provisions of CRS 29-21-201.

3)      That the Governing Board of El Rancho Florida Metropolitan District  has duly             
authorized the making of this certification.
